Dear user, thank you for choosing Temple Click Mobile Application (herein after referred as “Application”). This application is developed and owned by M/s Vaigha Technologies Pvt. Ltd. a Company incorporated in India under the Companies Act 2013, having its Registered office at 7/297, Ratnalayam, SN Puram PO, Thiruvizha, Cherthala , Alappuzha, Kerala, India 688582 (hereinafter referred to as the “ Service Provider”)
Your access and usage of this application is entirely and exclusively governed by the following terms of usage and by agreeing to the same you will be in a contractual relationship with the “Service Provider” and your access and usage will be governed by the said terms and conditions in terms of use agreement as agreed and stated below.
Please read these terms carefully before accessing or using the application.
This application is meant for individual users access to the application from anywhere in the world and your access and use of services confirms your consent to be bound by the terms and conditions of this agreement of usage. If you don’t propose to agree to these terms, you cannot access or use this application and you can exit the application immediately.
That the Service Provider holds exclusive rights to determine the terms of service and usage provided in the application and the Service Provider is at its sole discretion to terminate / change all or any of the services or access to you individually or in general at any time without mentioning any reason what so ever. The Service Provider in its sole discretion may or can have cease to offer any services or deny access in part or full the services at any point of time without mentioning any reason or causes or what so ever.
The Service Provider is at its sole discretion and liberty to change/amend or alter or update the terms of services and access in due course of time or as and when found to be necessary by the Service Provider. Such change/amendment or alteration or updation made by the Service Provider in the terms of use will be immediately effective without any notice or further agreement with the user and such supplemental terms of services, alter, amend, addition shall be deemed as a part of the terms and service. Such additional change/alteration or amendment, whatever it may be, shall prevail over the existing terms in case of a conflict with respect to the existing terms of the applicable terms of service. The change/amendment updation will be notified only in the “Terms and Conditions” page of the application and your constant access and usage of the services establishes your consensus to be bound by such amendment, alteration, change or addition, updation as the case may be.
The service provider have its sole discretion to incorporate additional terms of service to certain specific service or a certain event and such terms will also be notified in the only in the “Terms and Conditions” page and your constant access and usage of the services establishes your consensus to be bound by such amendment, alteration, change or addition, updation as the case may be.
SERVICES
The services of the application constitute an Android /iOS platform enables the user of the Service Provider mobile application to arrange schedule and visit and offer devotion to the temples enlisted in the application located across the country. The temples that you accept and understand that the temples enlisted in the application are none owned, operated or managed by the Service Provider or any of its subsidiaries under any pretext. The Service Provider is under agreement with the enlisted third-party temples or its managements for extending the services to devotees, who accepts online platform and uses the application for fulfilling their devotional requirements for the services provided by the enlisted temples, through this application. Your access and agreement to the terms of services acknowledges that the Service Provider does not provide or offer any of the services or satisfaction or pleasure offered by the enlisted temples and Service Provider only functions as an online platform to avail the services provided by the enlisted 3rd party temples and the Service Provider is not the contractors nor employs any of the enlisted temples or their managements.
You are not allowed to infringe any copy right (Visible or other) or other intellectual property materials (Registered Or Unregistered) from the data provided in the application and shall not modify, copy, reproduce, transfer, broadcast, stream or shall not use the application in any manner detrimental to the interest of the “Service Provider” nor imitate the mode of the services provided in the application and also shall not use the application for any public performances under any pretext. You are not permitted to hinder the functionality or operation of the application by using any mode or shall not attempt to get authorized access to the “Source code” other relevant data or information the application or its related networks and systems.
The Service Provider only provides services offered by the 3rd parties for which new diverse terms and conditions may apply including in privacy policy to your service and the application for such 3rd party content and services they offer. The Service Provider has the complete discretion to allow post, or withdraw any advertisements or other promotions shown or posted in the application at any time and any number of times.
The Service Provider holds the sole discretion and liberty to associate/merge its service, brand or other conveniences provided in the application with its subsidiary applications or brands which affiliates similar service or any other diverse services from the present platform/application provided by using the user data or otherwise. The Service Provider does not claim or acknowledge that the 3rd party service providers to whom with the Service Provider is in agreement, for extending the service to the application, have all requisite permissions, licenses from the concerned authorities and the Service Provider hereby indemnify itself from any legal issues or other complications arise due to the absence of any such licenses or any statutory compliances, as the case may be.
You are permitted to keep only one “USER ACCOUNT” at a time. The services provided and all rights conferred therein shall be the exclusive property of the Service Provider and by granting access to the application you are not assigned with ownership or claims over any of the brand names, logo or other visible representations, trademarks owned or possessed by the Service Provider under any circumstances. This application is made and intended for the usage of persons with legal age of 18 years, However the Service Provider is not responsible or liable for any issue or loss caused to you or the device owner due to usage of the application by persons of non-legal age. For creation of an account as a user the Service Provider seeks some data which you must enter in the specified place provided in the application. The basic data collected for creating a user account are username, address, age, phone number and such other personal information which is required to be seems necessary by the Service Provider from time to time. Any failure from you to provide accurate and required correct data required by the Service Provider may result in failure or denial to access the application under your account.
You are liable to maintain the security feature of your device and the user name, password or other access details of the application in safe and secret mode and keep them from all unauthorized access and usage and in any such event that causes any loss of information or other loss or damage to you the Service Provider is not responsible for such loss or liable for the same. You are completely responsible for all the activities under your account.
On creating an account, you agree the Service Provider to access other applications and data of your device for the proper and effective functioning of the service provided through the application. Such consent includes the application to access managing of other inbuilt or installed applications in your device at any number of times.
The Service Provider in its sole discretion permit you to upload or publish any information feedback other support or service requests or your entry to any promotion or competition activities initiated by the Service Provider from time to time. You hereby agree that the Service Provider is the custodian of the user details provided by you and the Service Provider have the right to keep a royalty free license to use, copy modify and to create derivative works and explore the user data in any manner which the Service Provider needs to without obtaining any further notice, consent from you. The access to the user data by the Service Provider will be completely on free of costs and the Service Provider is not liable to pay any amount to the user.
You hereby acknowledge, confirm and consent that the user details provided by you in any manner infringe violates or is detrimental to the interest of any 3rd party or it violates the interest or rights of any 3rd party rights directly or indirectly. You hereby agree, ratify, and confirm that the user details provided by you are not defamatory or unlawful.
The Service Provider holds unconditional and exclusive right to remove or modify any user details provided by you if found necessary at any time for any reason without any notice to or consent from you. You hereby acknowledge that the application completely works on uninterrupted mobile networks of internet service and the Service Provider is not liable for any of the issue with the network related or other issues with the service provided including the cost of the network services. You also agree that the application may subject to malfunction or unexpected delay as may be due to technical or software, network, or other data errors which the Service Provider is in no way responsible to you under any pretext. The Service Provider is at its sole discretion to fix, decide on the rates, tariffs or other user fee details required from time to time for providing the services required. The Service Provider in under no obligation or liability for the refund of any payment made by you through the application or otherwise for availing any of the services enlisted in the application and no claims against the Service Provider will be entertained. You hereby unconditionally indemnify the Service Provider from all claims and responsibilities of payments made by you through the application.
The Service Provider shall not be liable for any direct or indirect punitive or consequential damages caused to you by use of the above application under any circumstances what so ever. You hereby agree to indemnify and to keep indemnified the Service Provider its subsidiaries, employees or any other 3rd parties working for and under the SERVICE PROVIDER from all demands, losses and expenses, damages arises out of this agreement and by usage of the application thereof.
All disputes arising out of this agreement shall be resolved and decided through arbitration by 2 Arbitrators appointed by both you and Service Provider and the governing law shall be the laws in India and the place of arbitration shall be at Ernakulam in India.
On your agreement to the above-mentioned terms of services, the Service Provider hereby permits your access and use of the application on your own device solely subjected to the terms of services and you are also permitted to perceive and use all the content, information and associated materials made available through the application for your sole personal use. Your access to the application will be non-exclusive, revocable and limited.
